Article 31-c: Abuse of the Right to File an application
The Constitutional Court, upon finding that the applicant or his/her legal representativesubmits an abusive or repeated application for the same cause and subject-matter, although being examined once by the Constitutional Court, or upon finding that the applicant or the legal representative has hidden or distorted facts and circumstances connected to the case, shall order that the applicant or his legal representative be fined in the amount from 100 000 to 500000 ALL. Upon the Constitutional Court finding that it encounters cases of forgery of documents or another criminal offence, it shall simultaneously send the materials to the prosecution office for investigation.
The decision shall, in the cases provided for in paragraph 1 of this Article, be taken by the Meeting of Judges, upon the proposal of the Chairperson or rapporteur of the case.
The fine imposed by the Meeting of Judges shall be an executive title.
