1Precautionary measures shall be ordered upon request of the prosecutor who presents to the competent court the reasons supporting his/her request. The decision shall be taken in closed session and issued in reasoned form.
2Even if the court declares its lack of competence for any reason, in case the conditions and urgent need for the adoption of a precautionary measure exist, the court shall order the adoption of such precautionary measure and transfer the acts to the competent court.
3The court cannot establish a precautionary measure that is more severe than the one requested by the prosecutor.
