1Except the cases when inferred in the hearing, the appeal is not admitted in closed session:
awhen it is made by who is not legitimated;
bwhen the decision is not subject to appeal;
cwhen the provisions regarding the form, submission, sending, notification and the time limits of appeal have not been respected;
çwhen the appeal has been withdrawn during the trial;
dthere is no longer a subject matter of appeal.
2The non-admission may be declared, also ex officio, in any state or stage of the proceedings.
3The decision of non-admission is notified to the one who has filed the appeal, and it it subject to appeal to the High Court, within its competence.
4When the court decides the non-admission of the appeal, the decision shall be considered as not appealed for execution purposes.
