1In any case, when the mental condition of the defendant shows that he must be treated, the court decides, even ex officio, the hospitalization of the defendant in a psychiatric institution.
2When it has been or should be decided a compulsory medical measure to be taken towards the defendant, the court orders that the defendant is held in a psychiatric institution.
3During preliminary investigations, the prosecutor requests the court to decide on the hospitalization of the defendant in a psychiatric institution and, if delay may be prejudicial, orders the temporary hospitalization until the court takes a decision.
