1When during the preliminary investigations or during their conclusion the prosecutor ascertains lack of jurisdiction for any reasons, he transfers the documents to the prosecutor attached to the competent court.
2If the prosecutor declares the non-competence, he shall immediately inform both courts. The court shall, within three days upon receiving the prosecutor’s notification, transmit to the competent court the acts of the preliminary investigation conducted until that moment before that court.
