1Act of assurance is issued by the competent public organ only upon request of the parties and has at any case a written form.
2If prior to the issuing of the act of assurance, the competent public body considers that there must be a hearing with the person or persons, or under the law the participation of another public organ is required, the act of assurance shall be issued after the hearing of the person or persons or the participation of the public organ.
3If after the issuance of the act of assurance, the facts or legal basis of the case change in such an extent that if the organ would have been aware of this change, it would not have issued the act of assurance, the latter shall no longer be mandatory for the public organ body.
