1Discretion shall be lawfully exercised when it is in line with the following conditions:
ait has been provided by law;
bit does not go beyond the limits of the law;
cthe selection of the public body was made only to achieve the objective for which the discretion was allowed, and is in line with the general principles of this Code; and
çthe choice does not constitute an unjustified departure from previous decisions made by the same body in identical or similar cases
