Article 252: Conditions for dismissal of the Director of the School

1The Director of the School of Magistrates shall be dismissed from duty by the Steering Council when:

ahe/she reaches the retirement age;

bthe four-year term ends and he/she is not re-elected;

che/she resigns;

çhe/she is incapable of performing the duty;

dhe/she is dismissed under the provisions of paragraph 2 of this Article.

2The Director of the School of Magistrates shall be dismissed from duty by the Steering Council, if:

aconditions of ineligibility and incompatibility in performing the function have been established;

bhe/she committed a serious professional or ethical misconduct, which discredit his/her position and image;

che/she has been convicted by a final court decision for committing a crime.

3The Director of the School of Magistrates shall be suspended from duty by decision of the Steering Council, if:

athe personal precautionary measure “arrest in prison” or “house arrest” has been imposed against him/her for committing a criminal offence;

bhe/she is a defendant for a serious crime committed deliberately;

4The Director of the School of Magistrates may be suspended from duty by decision of the Steering Council, if disciplinary proceedings are initiated, according to the law.

5The decision of dismissal may be appealed against before the First Instance Administrative Court.
