1Member of the Commission and judge of the Appeal Chamber shall be appointed the Albanian citizen who fulfils the following conditions:

aHas completed the second level of university law studies with the degree ‘master of science’ in Albania or law studies abroad and has obtained an equivalent degree according to the rules on recognition of diplomas foreseen in the law;

bHaving a professional experience of not less than 15 years as judge, prosecutor, advocate, professor of law, civil service employee at senior level or another recognised activity in the field of administrative law or in other fields of law;

cHaving obtained a high score for his or her professional and ethical skills and moral integrity, as long as he or she has been subject to previous evaluation;

çHas not held a political post in the public administration or has not held leadership positions in a political party for the last 10 years;

dIs not under criminal investigation and has not been convicted by a final decision in connection with the commission of a crime, a criminal misdemeanour deliberately or has not been subject of the limitations provided in the law “On guaranteeing the integrity of the elected, appointed persons or who exercise public functions;

dhHas not been subject to the disciplinary measures of dismissal or any other disciplinary measure in force under the law at the time of application;

eHas not been a member, collaborator or favoured by the State Security before 1990 in the meaning of the Law “On the right to information regarding the documents of the former security service of the People’s Socialist Republic of Albania;

ëHas not been judge, prosecutor, legal advisor or legal assistant during the last two years prior to their nomination;

fHas not been member of the High Level Experts of the ad hoc Committee for the reform in the justice system, or expert appointed by the political parties and the Ministry of Justice;

gShould not be older than 65 years;

gjHas very good knowledge of English language;

2Compliance of the above mentioned criteria shall be evaluated taking account specifically of the following data:

aAcademic grade in the field of law;

bSpecial experience of the candidate in a certain field of law;

cSeniority in the profession;

çStudy experience and professional experience abroad;

dHaving an average mark of not less than 8 in case he/she has completed the second level of university law studies with the degree ‘master of science’ in Albania or law studies abroad and has obtained an equivalent degree according to the rules on recognition of diplomas foreseen in the law;

3Conditions and criteria provided in paragraph 1 of this Article apply accordingly for the appointment of a Public Commissioner, with the exception of the years of experience which should be not less than 10 years.
