1A Council shall decide to close the disciplinary proceeding without a hearing if:
athe disciplinary misconduct has already lapsed at the time of initiating the investigation, as provided for in Article 117 of this Law;
bthe case was already subject of a disciplinary proceeding finalized by a final decision;
cthere are grounds for closing the investigation in accordance with Article 134 paragraph 1 letter ç) and d);
çthe investigation report was submitted without any reasoning.
2The resignation of the magistrate does not prevent the initiation or continuation of the disciplinary proceeding.
3The Council shall close the disciplinary proceeding under paragraph 1 of this Article by a reasoned and written decision. It shall notify the parties on the reasons of the closure.
