1Prosecutor’s functions are carried out:
aduring preliminary investigations and first instance trials, by prosecutors attached to first instance courts;
bduring trials of appealed cases, by prosecutors attached to the courts of appeal and High Court.
2The prosecutor is independent in the exercising of his functions. Rules on the manner regarding the exercising of the prosecutor’s functions are provided by the law.
3The functions under Article 24 of this Code shall be exercised by the prosecutors of the Special Prosecution Office in all instances for criminal offences referred to in Article 75/a of this Code.
