1The prosecutor, when proceeding to carry out a search or sequestration, notifies the defendant to be present together with his retained lawyer and, if he does not have one, shall appoint him a lawyer ex officio.
2If the defendant and his defense lawyer have been duly notified, but are not present without any reasonable cause, a lawyer shall be appointed ex officio. This fact is reflected in the relevant minutes.
