1When the criminal prosecution should not have started or should not continue, pursuant to the cases provided for in letters “c”, “ç”, “e” and “ë”, of paragraph 1 of article 328, of this Code, or when the criminal offence is extinguished and the defendant does not request for acquittal, the court shall decide dismissal of the case, by indicating also relevant reason.
