1The court issues a conviction decision, when the guilt of the defendant is proven beyond any reasonable doubt, and establishes the type and measure of penalty.
2The court cannot base the conviction decision only on statements made by persons, who, out of their own free choice, have always voluntarily avoided undergoing questioning by the defendant or his lawyer in all stages of the proceedings.
3The court cannot base the conviction decision only or mainly on the statements of the co-defendant or the testimonies obtained through special techniques for hiding the witness identity, pursuant to article 361/b of this Code.
4When the defendant has committed more criminal offences, the court shall establish the sanction for each of them and shall apply the rules on the unification of criminal offences and sanctions.
