1When a person is sentenced instead of another person because of error relating to the name, the court decides the correction only in case the person who should be subjected to proceedings is summoned as a defendant also with another name to appear in trial. To the contrary, it is decided the review of the case pursuant to the article 450, paragraph 1, letter “c”. In any case, the execution against the person who is convicted by mistake is suspended.
