Article 63: Constitutional Court Decision Making

  1. Where the Constitutional Court concludes that the President of the Republic has seriously violated the Constitution or has committed a serious crime, it shall declare his dismissal from office. In this case, the decision of the Constitutional Court shall enter into force on the day of announcement and it shall be published right away in the Official Journal.
  2. Where the Constitutional Court does not conclude that the President of the Republic hasseriously violated the Constitution or has committed a serious crime, it shall decide to repeal the decision of the Assembly of Albania.
  3. Resignation of the President of the Republic or the completion of his mandate, after theConstitutional Court has commenced reviewing the case, shall not constitute a reason to dismiss the case.
  4. Where the declaration of dismissal from office of the President of the Republic is decided on, the President shall not benefit the special treatment provided to senior officials.
  5. Rules laid down in Article 61, paragraph 1, 2 and 3, shall also apply in case of finalverification of the fact of permanent inability of the President of the Republic to perform duties. In this case, the Constitutional Court shall decide on the establishment of the fact of inability to perform the duty or shall overturn the decision of the Assembly.
