Article 9: End of Mandate

1. The mandate of the judge of the Constitutional Court shall end in the following cases:

a) Upon reaching 70 years of age;

b) Upon completing the 9-year mandate;

c) Upon his\her resignation;

ç) Upon being dismissed under the provisions of Article 128 of the Constitution;

d) Upon establishing the conditions of non-electability and incompatibility in assuming the function;

dh) Upon establishing the fact of inability to perform his/her duties.

  1. The end of mandate of a judge shall be declared by decision of the Constitutional Court.The request for the declaration of the end of the mandate of a judge shall be made by the Chairperson of the Constitutional Court.
  2. The Chairperson of the Constitutional Court, no later than 3 months before the end of the mandate of a Constitutional Court judge, under paragraph 1, letter “a” and “b” of this Article, as well as after the early termination of the mandate, shall notify the appointing body regarding the vacancy. The procedure for the appointment of the new judge shall be completed no later than 60 days from the decision of the Constitutional Court that declared the end of the mandate.
  3. The President of the Republic and the Assembly of Albania shall in any case be notified about the end of the mandate of a judge.
