1 An administrative procedure may be instituted either ex-officio or based on a request.
2The ex-officio institution of a proceeding is at the discretion of the public body. The public body shall be obliged to ex-officio initiate an administrative procedure in cases where:
athe laws or a sub-legal acts has provided for the initiation of the proceeding,
bthe factual situation is such that requires the public body to initiate the administrative proceeding for the protection of public interest.
3The administrative proceeding shall be deemed instituted:
awith the performance of any procedural action by the public body in case of an exofficio instituted proceeding, or
bwith the submission of a request before the public body, in case of a procedure instituted upon request.
