Article 94: Internal rules of the courts

1The High Judicial Council shall adopt standard rules for the internal functioning of the courts.

2The internal rules of courts shall contain rules about the structure of the courts, efficiency and quality of justice provided in these courts.

3The standard rules for the structure shall contain at least the following arrangements:

astandard organisational structure of courts of all instances;

bstandard description of tasks and responsibilities for each category of employees of the courts.

4Standard rules for the efficiency of justice shall include provisions on:

astandard time limits for adjudicating various types of court cases, including, where appropriate, the deadline for the main stages of the procedure, the execution of decisions, keeping in mind the judicial organization and procedural rules;

bstandard rules to be used by the courts to determine the deadline taking into account the complexity of the cases with the goal of continuously improving the case management system;

cstandard actions to be taken in cases where examination of cases exceeds the deadlines;

çstandard rules for monitoring the duration of suspension resulting from the omission of the parties or the courts;

dstandard rules for monitoring and dissemination of data for the court staff and all users of the courts;

dhGuideline on keeping judicial statistics;

eGuideline on an active role of judges in case management;

ëGuideline on monitoring adjournments of hearing sessions;

fmodels of judicial decisions;

gGuideline on the use of audio visual technology in the judicial process;

gjGuideline on the use of information technology and the taking of evidence in courts;

hCreation of mechanisms to solve functional problems and balanced distribution of workload between judges and courts;

5Standard rules on the quality of justice include, inter alia, and indispensably even the following adjustments:

adevelopment of surveys on the assessment of court services by court users;

bdevelopment, testing and use of indicators for the quality of judicial services;

cmeasures to improve the quality of work of judicial experts;

çmeasures to improve access to justice;

6The High Judicial Council may conduct pilot studies in cooperation with the courts in order to enhance the quality and efficiency of the courts.
