Article 35: Suspension and discharge from duty of the Director of the National Bureau of Investigation

1The Director of the National Bureau of Investigation shall be released by the High Prosecutorial Council when;

aHis or her mandate is over;

bHe or she submits a resignation;

cHe or she reaches retirement age;

2The Director of the National Bureau of Investigation shall be discharged from duty by the High Prosecutorial Council, based on the recommendation of the Chief Prosecutor of the Special Prosecution Office when:

aHe or she is convicted by a final court decision for commission of a criminal offence;

bFor violation of the Constitution or serious violation of law during the exercise of duty;

cFor serious and very serious discipline violations while exercising his or her functions.

çWhen new facts emerge that are verified and are contrary to the criteria set for his or her appointment.

3The Director of the National Bureau of Investigation shall be suspended by the High Prosecutorial Council upon recommendation of the Chief Special Prosecutor if the Director is the subject of a criminal investigation. The suspension shall continue as long as reasons for the suspension exist.
