Article 279: Obligation to keep secrecy

1Investigation documents are secret until the defendant has not received any information about them. When it is necessary for the continuation of the investigations, the prosecutor may order that particular documents be kept secret until the conclusion of the investigation.

2The prosecutor may allow, by reasoned decision, the publication of particular documents or parts thereof. The documents made public are filed with the prosecutor’s secretary office.

3Even when the acts are no longer bound by secrecy, pursuant to paragraph 1 of this Article, in cases when this is necessary for the continuation of the investigations, the prosecutor may rule, by reasoned decision:

athe obligation to preserve secrecy on specific acts, when the defendant gives his/her consent or when the content of the act might jeopardise investigations against other persons;

bthe prohibition of the publication of the contents of specific acts or data related with certain investigative actions.
