1Waiver of the right to lodge a complaint is made personally or through a representative, by means of a signed or oral statement before the prosecutor or a judicial police officer, who keeps minutes, to be mandatory signed by the person making the statement.
2Provisional or conditional waiver is not valid.
3The same statement may also contain the waiver in respect of the civil claim.
