1When during the trial, another criminal offence connected to the offence under trial, pursuant to the article 79, letter “b”, or when an aggravating circumstance which is not stated in the trial application emerges, the prosecutor communicates to the defendant the criminal offence or the circumstance, provided that the trial is not under the competence of a superior court.
